TERMS AND CONDITIONS OF SALE

The owner of the online store www.marimofashion.com (hereinafter “Online Store”) is Marimo Fashion OÜ (registry code 12087987), located at Müürivahe 17, Tallinn 10140, Estonia.

VALIDITY OF THE SALES CONTRACT, PRODUCT AND PRICE INFORMATION

These Terms apply to purchases made in the Online Store.

The prices of products sold in the Online Store are shown next to the products. Delivery costs may apply depending on the chosen delivery method. All prices are in euros.

TAXES AND DUTIES
We ship all international orders on a
 Delivery Duty Paid (DDP) basis whenever possible, meaning that taxes and import duties are included in the final price shown at checkout.

However, please note that in some countries or in rare cases, local customs authorities or couriers may still charge additional import fees upon delivery. These charges, if applied, are the responsibility of the customer. We do our best to help the customer in this situation.

Information about the products is provided directly next to each product in the Online Store.

PLACING AN ORDER

To order goods, add the desired products to the shopping cart. To finalize the order, complete the required fields and choose the appropriate delivery method. The total cost will then be displayed, which can be securely paid using the following payment methods:

·       Estonian bank payments

·       Visa/Mastercard card payments

·       Paypal, Apple Pay and Google Pay

·       Marimo gift card

When paying via bank link, please click the “Back to Merchant” button after the payment.

Payments are mediated by Maksekeskus AS. Payment takes place outside of the Online Store in a secure environment – in the case of a bank link, in the secure environment of the respective bank; in the case of a card payment, in the secure environment of Maksekeskus AS. The seller does not have access to the customer’s bank and card details. The contract enters into force once the payment has been received into the Online Store’s account.

The owner of the Online Store is the controller of personal data and forwards the personal data necessary for making payments to the authorized processor Maksekeskus AS.

If the ordered goods cannot be delivered due to stock depletion or other reasons, the customer will be notified as soon as possible and the payment (including delivery costs) will be refunded immediately, but no later than 14 days after the notification.

DELIVERY

Please note that most garments are made-to-order.

·       Standard-size orders are shipped within 7 working days.

·       Made-to-measure garments are shipped within 4–6 weeks after your measurements have been received and confirmed.

·       If you require faster delivery, please contact us at info@marimofashion.com and we will do our best to accommodate your request.

Delivery methods and costs:

·       Estonia: Free Standard Delivery with Omniva or Itella (depending on location). Delivery usually takes 1–3 working days once the garment is ready.

·       Europe: Free Standard Delivery by international post (7–30 working days depending on courier and location). Express Delivery available via UPS or FedEx for 79 EUR (delivery within 1–2 working days once the garment is ready).

·       United States of America (USA): Express Delivery via UPS or FedEx for 79 EUR (delivery within 1–2 working days once the garment is ready).

·       Rest of the World: Express Delivery via UPS or FedEx for 79 EUR (delivery within 1–2 working days once the garment is ready).

In exceptional cases (including force majeure), delivery times may be extended. The Online Store has the right to deliver the goods within up to 45 calendar days.

RIGHT OF WITHDRAWAL AND RETURNS

·       Standard-size orders can be returned within 14 days of receiving the item.

·       The customer is responsible for the return shipping costs unless the return is due to a defect or incorrect item.

·       Return labels are included in the package for your convenience.

·       Made-to-measure garments are non-returnable and non-refundable.

·       Exchanges are only possible if you received the wrong product.

·       Alterations can be arranged, but only after we have confirmed your request by email. If alterations are needed after you have received your garment, please contact us within 14 days. If the customer requests an alteration after receiving a garment, the customer will cover the return shipping. If the alteration is required due to a mistake on our part (such as an issue with fit caused by us), we will cover the shipping costs.

To exercise the right of withdrawal, please email us at info@marimofashion.com within 14 days of receiving your order, stating your order number and whether you would like to request a return, exchange, or alteration.The customer must not return any goods before receiving our confirmation email.

After we have confirmed the return request, the customer must return the goods within 14 days or provide proof that the goods were handed over to the carrier within that period. The customer must return the goods within 14 days after sending the withdrawal e-mail and receiving a confirmation from us, or provide proof that the goods were handed over to the carrier within that period.

The Online Store will refund all payments received from the customer under the contract immediately after receiving the returned goods, but no later than 14 days from the date of receipt of the withdrawal request e-mail.

The Online Store may withhold the refund until the goods have been returned or until the customer has provided proof of returning the goods, whichever is earlier.

The Online Store has the right to withdraw from the sales transaction and demand the return of goods if the price of the goods in the Online Store was mistakenly marked significantly below the market price.

RIGHT TO FILE A COMPLAINT

The Online Store is responsible for any non-compliance of the goods with the terms of the contract, or for defects existing at the time of delivery, that become apparent within 14 days after the goods have been handed over to the customer. The customer carries the burden of proof.

Customers have 14 days to return unworn products. If any issue arises, we review each case individually and do our best to find a fair solution. Please note that returns are only accepted for unworn products and do not apply to made-to-measure items.

In case of a defect, the customer must contact the Online Store within 14 days of receiving the goods by sending an e-mail to info@marimofashion.com or by calling +372 5620 2770.

The Online Store is not liable for defects that arose after the goods were delivered to the customer.

If goods purchased from the Online Store are defective, for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will refund all fees associated with the sales contract.

The Online Store will respond to the consumer’s complaint in writing or in a format that can be reproduced in writing within 15 days.

DIRECT MARKETING AND PROCESSING OF PERSONAL DATA 

The Online Store uses the personal data entered by the customer only for processing the order and delivering the goods. Personal data is forwarded to the transport service providers for delivery.

The Online Store sends newsletters and offers to the customer’s e-mail address only if the customer has given consent.

The customer may opt out of offers and newsletters at any time by notifying us via e-mail or by following the unsubscribe instructions in the newsletter.

DISPUTE RESOLUTION

If the customer has complaints regarding the Online Store, these must be sent to the e-mail address info@marimofashion.com or by calling +372 5620 2770.

If the customer and the Online Store are unable to resolve the dispute by agreement, the customer may turn to the Consumer Disputes Committee. The procedure can be reviewed and an application submitted at https://komisjon.ee. The Committee has competence to resolve disputes arising from contracts between the customer and the Online Store. The review of the customer’s complaint by the Committee is free of charge.

The customer may also turn to the Online Dispute Resolution platform of the European Union at https://consumer-redress.ec.europa.eu/index_en
